"Agreement" means the agreement between You and Us incorporating these terms and conditions for the provision of the Service, as amended from time to time in the manner set forth herein; "We, Us, Our" means MISS4YA; and "You, Your, Yourself" means the person who registers for the Service, accepts the terms and conditions of this Agreement and whose application for membership of the Service is accepted by Us.

1. ELIGIBILITY

MINORS MAY NOT BECOME MEMBERS. By becoming a Member, You represent and warrant that You are at least 18 years old. By using the Service, You represent and warrant that You have the right, authority and capacity to enter into this Agreement and to abide by the terms and conditions of this Agreement. Your membership for the Service is for Your sole, personal use. You may not authorize others to use Your membership, and You may not assign or otherwise transfer Your account to any other person or entity.

2. DESCRIPTION OF SERVICE

We refer to the Website and all services provided through the Website as the "Service".
MISS4YA is a communication website for men from all over the world and women from Ukraine and Russia. We ARE NOT A MARRIAGE AGENCY and do not offer any matrimonial services. We charge users for utilizing online communication facilities. MISS4YA has no personal relations with the women on the site. We DO NOT VOUCH for the ladies' conduct as well as we cannot guarantee that all ladies are genuine.

The Website allows subscribers to get in touch with anyone who has posted a profile on the Website. You agree that the Service is provided as is and that we do not provide any guarantee or assurance that our Website or the Services will operate continuously or without interruptions or be error free or be fit for any particular purpose. Accordingly, we cannot accept liability for its unavailability or the timeliness, deletion, mis-deliver or failure to store any user communications or personalization settings or that the Service will meet your requirements. You assume full responsibility and risk for your use of the Website and use of all information contained within it.

The Website is an internet information service that facilitates contact between persons who may or may not be seeking friendship or a relationship. The Company makes no, and expressly disclaims all, representations or warranties as to the conduct of Members. We are not responsible for any disputes or disagreements between you and any third party you interact with using the Service. This includes disputes between Members. You assume all risks associated with dealing with any and all Members, or other third parties, including without limitation the risk that information about a certain Member posted on the Website or information provided by a Member in the course of interactions with other Members via the Service may be false or misleading. You agree to resolve disputes directly with the other party. You release the Company of all claims, demands, and damages in disputes among Members of the Service or other third parties. You also agree not to involve us in such disputes.

Loss of business, lost profits, trade secret  misappropriation, intellectual property infringement, and/or any other damages resulting from communications or 

Meetings with other members of this service or persons you meet through the service.

The information provided through the service, and/or the interaction(s) between any members of the service, whether arising under contract, tort or otherwise. 

 

The Website is only a technical platform and a venue for individuals to communicate with each other by means of the Services. While the Company is making its best to check if Members are real people, we are not required to screen or censor all information posted in the profiles such as photos or personal data on the Website on each member, including but not limited to the identity of any Member. We are not involved in any actual communication between individuals on the Website.   

 

MISS4YA reserves the right to make changes or corrections, alter, suspend or discontinue any aspect of the Website or the content or Services available through it, including your access to it. Such changes or additions shall take effect within a reasonable amount of time. You are advised to check the Website every now and again to keep yourself up to date with any changes.

3. YOUR USE OF THE SERVICE: As a Member, You agree that:

(1) You will use the Service in a manner consistent with any and all applicable laws and regulations. You will not include in Your profile any telephone numbers, street addresses, last names, URL's or email addresses, other than in response to Our prompts in the personal or general information sections of the Websites. You will not engage in advertising to, or solicitation of, other members to buy or sell any products or services through the Service. You will not transmit any chain letters or junk email to other members. You are solely responsible for Your interactions with other members. We reserve the right, but have no obligation, to monitor and/or mediate disputes between You and other members.

(2) You are solely responsible for the content or information You publish or display (hereinafter, "post") on the Service, or transmit to other members. You will not post on the Service, or transmit to other members or to Us or Our employees, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity). You will not include in Your profile any offensive language, including but not limited to offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, and You will not post any photos containing nudity or personal information. We reserve the right, but We have no obligation, to reject any profile or photo that does not comply with the prohibitions set forth in this section. We reserve the right to refuse service to anyone, at our sole discretion.

4. FEES

Since some of our services are non-free, we take fees for sending letters, instant messaging (online chat), using video streaming, viewing video presentations, gift delivery. All prices are available for registered members in 'Buy Credits' section. You can pay for the services via major credit cards, Western Union or Moneygram or Paypal transfers. We may change our fee schedule at any time and the new fee schedule shall be enforced immediately upon publication of the same on our Website or upon notice to you via email. All currency references are in the US Dollars. Please read our refund policy carefully before you use MISS4YA and pay for the services. You become eligible to submit a request to an Admitted Member for his/her personal contact information once the foregoing conditions are met: you have spent at least 3000 credits on letters or Text chat messages to this Member. In response to such a request, the following contact information of the Admitted Member is provided: name and surname, address of residence, contact telephone number ( if available). Gifts delivery (you order purchase and delivery of goods via the Website as gifts to Admitted Members) - the value in Credits for a specific gift is available on the Website.

5. MEMBERSHIP

There is no membership subscription at our Website. Your profile will be posted for free after getting through the registration procedure.

6. PRIVACY

The personal information (including sensitive personal information) You provide to Us will be stored on computers and/or servers. You consent to the use this information to create a profile of interests, preferences and browsing patterns and to allow You to participate in the Service. You also agree to read, review, comply with, uphold and maintain Our Privacy Statement and the terms and conditions thereof. By using the services you have also agreed with our Privacy Statement. You represent and warrant to us that the information posted in Your profile, including Your photograph, is posted by You and that You are the exclusive author of Your profile and the exclusive owner of Your photographs. You assign to Us, with full title guarantee, all copyright in Your profile, Your photographs posted, and any additional information sent to us at any time in connection with Your use of the Service. You waive absolutely any and all moral rights to be identified as author of Your profile and owner of Your photograph and any similar rights in any jurisdiction in the world. In addition, other Members may post copyrighted information, which has copyright protection, whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which You have been given express written permission, You will not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Each time you use our paid services our system deducts your account (not your credit card), i.e. for each letter sent, for each minute of instant messaging and video streaming your account is debited for respective number of credits (lookup the costs in 'Buy credits' section). The credits can be reimbursed to your Miss4ya account under the following circumstances

a. You have encountered a credit loss as a result of errors or bugs on the site.
b. You have not been rendered a service that you paid for (e.g. a letter was not delivered, a gift was not shipped, etc).
c. You have sent repetitive letters to the same lady by mistake.
d. Other reasons which are provided by you and accepted by Miss4ya.

Money Refund:
